What Each Program Actually Does

The Safety and Treatment Program is West Virginia's mandatory DUI education and assessment framework. You attend classes, complete an assessment, and follow any recommended treatment. The program does not give you driving privileges. It satisfies one of the state's reinstatement conditions.

Test and Lock is the mechanism that allows you to drive during revocation. You install an ignition interlock device on your vehicle, drive only that vehicle, and submit to random breath tests before the engine starts. The program provider reports your compliance to the DMV. Test and Lock gives you restricted driving privileges in exchange for monitored sobriety.

Neither program replaces the other. You need both to satisfy West Virginia's DUI revocation reinstatement requirements. The confusion comes from their sequencing: Safety and Treatment must be enrolled in or completed within 60 days of beginning Test and Lock, but Test and Lock itself can start before your revocation date.

How to Enroll in Test and Lock Before Revocation

The application process begins with an approved interlock provider, not the DMV. You coordinate timing so the DMV receives your completed application before your revocation date.

Contact a West Virginia-approved ignition interlock provider as soon as you receive your revocation notice. The provider schedules device installation, collects required documentation, and submits your Test and Lock application to the WV DMV Interlock Section on your behalf. You must own the vehicle where the device will be installed, or provide written approval from the owner. If you lease, the leasing company must authorize interlock installation in writing.

Enroll in the Safety and Treatment Program within 60 days of beginning Test and Lock. The DMV Interlock Section verifies your Safety and Treatment enrollment or completion as part of your application review. You do not need to finish Safety and Treatment before applying for Test and Lock — enrollment alone satisfies the 60-day rule. If you are appealing your revocation, you are not eligible for Test and Lock until the appeal resolves.

What Happens If You Wait Until After Revocation

If your revocation date passes before the DMV approves your Test and Lock application, your license enters full revocation status. You cannot drive at all during the 20-day processing window. No exceptions exist for work, medical appointments, or family emergencies. The interlock device sits installed in your vehicle, but you have no legal authority to start the engine.

The processing clock does not start until your provider submits a complete application with all required documentation. Missing a signature, an incomplete Safety and Treatment enrollment form, or a vehicle owner authorization letter resets the timeline. Providers vary in how quickly they submit applications after installation — ask your provider for their typical submission window and add that to the 20-day DMV processing period.

Once approved, you receive a Test and Lock restricted license by mail. The license lists the vehicle where your interlock is installed and restricts you to driving only that vehicle. Driving any other vehicle, even in an emergency, violates your Test and Lock terms and triggers automatic revocation of the restricted license.

This fee is separate from interlock device costs, Safety and Treatment program fees, and any court fines.

Insurance During Test and Lock

West Virginia does not use SR-22 or FR-44 financial responsibility certificates. The old certificate framework under WV Code 17D-4-15 through 17D-4-20 is fully repealed. West Virginia enforces compulsory insurance through the Online Insurance Verification Program, which monitors your coverage status electronically.

You must maintain continuous liability insurance meeting West Virginia's minimum requirements: $25,000 bodily injury per person, $50,000 bodily injury per accident, and $25,000 property damage. Your insurer files a WV-1B Certificate of Insurance with the state when you purchase a policy. If your coverage lapses at any point during Test and Lock, the DMV receives an automatic notification and may revoke your restricted license.

Not all carriers write policies for drivers in Test and Lock. The interlock requirement and recent DUI conviction place you in the non-standard insurance tier. Expect higher premiums than you paid before revocation.
