You cannot be actively appealing your DUI revocation while enrolled in Test and Lock. If you hold an out-of-state license, you must provide a copy of your resident-state license to the WV DMV within 30 days of enrollment.

The program is available only for alcohol-based DUI revocations. Drug-related DUI revocations are not eligible for Test and Lock enrollment. If your revocation stems from a drug DUI, you have no interim driving option and must serve the full revocation period before applying for reinstatement.

How to Enroll Before Your Revocation Date

You must provide proof of enrollment in the Safety and Treatment Program within the 60-day window.

If you apply before your scheduled revocation date, the DMV processes your enrollment while you still hold driving privileges under your current license. Once approved, you transition directly to interlock-restricted driving without a gap. If you wait until after the revocation date, you lose all driving privileges during the 20-day processing period. The DMV does not backdate approvals or issue temporary permits while your application is pending.

What Happens If You Violate Program Terms

The ignition interlock device logs every breath test, every failed start attempt, and every attempt to tamper with or bypass the system. The provider downloads this data monthly and reports violations to the DMV Interlock Section. A single failed breath test does not automatically terminate your enrollment, but a pattern of violations or any attempt to circumvent the device triggers immediate program removal.

Missing two consecutive Safety and Treatment Program classes results in automatic Test and Lock revocation in most cases. The DMV does not issue warnings before revoking your interlock privileges. Once removed from the program, you revert to the full revocation period with no interim driving option. You cannot re-enroll in Test and Lock after a program violation; you must serve the remainder of your revocation period and then apply for full reinstatement.

Driving any vehicle without an installed interlock device while enrolled in the program is a separate criminal offense. This includes borrowing a friend's car, driving a rental vehicle, or operating a work vehicle that does not have your assigned interlock device. Every vehicle you drive must have the device installed and must be registered with your provider.

Insurance Requirements During Test and Lock

West Virginia does not use SR-22 or FR-44 certificates. The old financial responsibility certificate framework was repealed, and the state now enforces compulsory insurance through the Online Insurance Verification Program. You must maintain continuous liability insurance meeting West Virginia's minimum requirements: $25,000 bodily injury per person, $50,000 bodily injury per accident, and $25,000 property damage. Uninsured motorist coverage is also required.
